    The following terms and conditions apply to users, viewers and all persons who have access to (this “site”). By using or viewing this site, you agree to these terms. If you do not agree, do not use this site. Any access or use of this website is done at your own risk.

    Resolution No. 274 of November 5, 2009 of the Internal Revenue Service:
    The transaction of sale of tangible goods (…) is configured as indirect electronic commerce in that the commercial transaction takes place electronically, but the customer receives the physical delivery of the goods to his or her home through traditional channels, i.e., through a carrier or forwarding agent (see Resolution No. 312/E of July 21, 2008, Resolution No. 133/E of November 15, 2004). For V.A.T. purposes, indirect e-commerce transactions are assimilated to mail-order sales and, therefore, are not subject to the obligation to issue an invoice (unless requested by the customer no later than the time the transaction is carried out), as provided for in Article 22 of Presidential Decree No. 633 of 1972, nor to the obligation of certification by issuing a receipt or fiscal receipt pursuant to Article 2(oo) of Presidential Decree No. 696 of December 21, 1996. Sales receipts must, however, be recorded in the seller’s register provided for in Article 24 of Presidential Decree No. 633 of 1972.

    The Conditions of Sale below govern the offer and sale of products on the website. Before placing an order, we encourage customers to read the conditions of sale carefully. Any changes or new conditions of sale will be effective from the time of publication on the site, and will apply only to sales concluded after publication.
    Submission of the order by the Customer shall be considered as acceptance of the conditions of sale in effect at that time.

    1) Registration
    In order to browse the site, view and/or purchase the products present, it is not necessary to register.

    2) Nature and Availability of the Products
    The products are those described in the pages of the website, where the name and characteristics of each are indicated; they are all available at our warehouses and ready to be shipped. Tonti Art’s Srls undertakes, in accordance with the law, to promptly inform the Customer of any unavailability of the possible unavailability of the product ordered. In this case, the buyer is promptly contacted and informed about the new time needed to process the order, or about the possibility of replacing the missing product with one of the same or similar value, or for a refund of the price paid.

    3) Purchases
    To purchase a product, simply click on the “Buy” button located under the photo-miniatures or within the detail pages of the items; the products will be added to the shopping cart, where you can change and/or modify the desired quantities. When completing your order, you will be able to choose whether or not to receive our newsletters; you can always unsubscribe from receiving them by clicking the Unsubscribe link at the bottom of the newsletter. All customers will receive an initial newsletter once they place their first order; they can exercise their right to unsubscribe with the same link at the bottom of each newsletter.

    4) Delivery
    Shipping of purchased goods is by GLS express courier, upon verification of payment, and is made within 2/4 working days (depending on the destination area). Verification of payment is immediate when you purchase by Credit Card or PayPal, it may take a few days when you choose the option “Bank Transfer” (in this case, we recommend that you email a copy of the transfer made). An accompanying invoice will be sent along with the goods ONLY IF EXPRESSLY REQUESTED BY THE CUSTOMER; otherwise, a receipt or tax receipt will be sent to the customer. For the issuance of the invoice shall be based on the information provided at the time of the order: please enter, in the appropriate field of the order, the unique code and / or pec address for the issuance of the electronic invoice; if these data are not communicated at the time of the order, the goods will be shipped with the tax receipt and it will no longer be possible to issue an invoice.

    5) Shipping costs
    Shipping costs are the responsibility of the Customer and are indicated at the time of the order. We deliver throughout Italy and the main European countries with the rates set out below, which vary depending on the quantity purchased and the destination: these costs are calculated automatically, based on weight, when the products are introduced in the cart and appear in the final summary, with a separate entry; in this way, you can check the cost of shipping before making the purchase. Shipping to Italy is free for orders over €189.
    Please note: in the event that the customer, when concluding the order, were to indicate an incorrect address – even a single part of it, such as wrong city or zip code – such as to cause a non-delivery by the courier, the resulting costs of storage for new delivery at the courier’s warehouse shall be borne by the customer.


    6) Packaging
    Products are shipped in their original packaging, properly wrapped in protective materials, and then packed damage-proof in case of accidental impacts.

    7) Payment
    The accepted payment methods are:

    • – PEACHPAY: is a plugin designed specifically for WooCommerce, to speed up the completion of an order (Buy with a click); again, payment is immediate. PeachPay makes use of the Stripe platform, open to all circuits (VISA, Visa Electron, VPay, MasterCard, Maestro, JCB, American Express, Diners); the cost of the transaction is borne by Tonti Art’s Srls.
    • – PAYPAL: payment is immediate, simply by logging into your PayPal account; for those who do not have an account, you can use your credit card by choosing a username and password; the creation of the PayPal account is free for the Customer, the cost of the transaction is borne by Tonti Art’s Srls.
    • – BANK TRANSFER: in this case, the verification of the payment may take a few days; we recommend sending the receipt of the payment made to the email moc.itnotoiziruamnull@ofni, specifying the reason, to hasten the process, but the goods will be shipped only when the funds are credited to the bank account indicated in the order confirmation email.

    8) What to do when the goods arrive
    Upon delivery of the goods by the courier, the Customer is required to verify that the number of packages corresponds to what was ordered and indicated in the transport document, and that the packaging is intact, undamaged or altered; if not, must be indicated in the transport document of the courier the clause “I ACCEPT WITH RESERVE”, specifying in pen the description of the anomaly.
    In this way, in the event that the products are damaged inside the box, the Customer can immediately refuse the delivery, and the goods will return to Tonti Art’s Srls without further expense to the Customer, who will of course be entitled to a refund of the order.

    9) Right of Withdrawal
    The Customer has the right to withdraw from the contract, without giving reasons, within 14 days, as per Legislative Decree 206/2005-D. Lgs. 21/2014 – implementing Directive 2011/83/EU. The withdrawal period expires after 14 days. The customer who wishes to make use of the right of withdrawal must send an e-mail, to the address moc.itnotoiziruamnull@ofni, a signed communication containing declaration of intention to exercise this right, indicating all the required data (order number, invoice number, the products subject to withdrawal) and the bank details on which to obtain the transfer (ABI – CAB – CIN – Current Account of the invoice holder). To this, you must wait for the communication of authorization to return the goods from our Customer Service. In order for the right of withdrawal to be exercised, certain conditions must be met: the purchased goods must be substantially intact and sent back in their original packaging, obviously the scarves, scarves and accessories subject to return must not have been used, must not be damaged or stained; shipping costs will be borne by the customer; upon its arrival at the warehouse, the goods will be examined to assess any damage or tampering, also due to packaging unsuitable for transport. In the event of a positive outcome, Tonti Art’s Srls will provide within 30 working days of receipt of the goods to make a refund of the amount paid, excluding shipping costs in accordance with art. 5, paragraph 6, Legislative Decree no. 185 of 22/05/1999, by bank transfer.
    In the event that a purchased good is not available, the customer will have the right to immediate (within 5 days) refund of the amount paid, including shipping costs, unless otherwise agreed between the parties (which may agree by telephone or by email a possible replacement of products purchased or a later shipment, in case of new availability of goods purchased).

    10) Competent Court
